Agreement to Terms

By accessing and using the services of Grace Notary Ink, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Services Provided

Grace Notary Ink provides mobile notary public services throughout Idaho, including but not limited to:

• General notarizations (acknowledgments, jurats, copy certifications)
• Loan signing services for mortgage and real estate transactions
• Mobile notary services at your location (home, office, hospital, care facility)
• Document witnessing and oath administration

Appointment Scheduling and Cancellation

Scheduling Requirements

• Advance Notice: Appointments must be scheduled at least 3 hours in advance. Same-day or emergency appointments may be available for an additional fee.
• Accurate Information: You agree to provide accurate contact information, appointment location, and service details when booking.
• Travel Time: Our pricing includes reasonable travel time within our standard service area.

Cancellation Policy

• Client Cancellations: Appointments may be canceled or rescheduled up to 2 hours before the scheduled time without penalty. Cancellations with less than 2 hours notice may be subject to a cancellation fee.
• Late Arrivals: If you are more than 15 minutes late to the scheduled appointment, we reserve the right to reschedule and may charge a trip fee.
• No-Show Fee: Failure to be present at the scheduled appointment time and location without prior notice will result in a no-show fee equal to the full appointment cost.
• Grace Notary Ink Cancellations: In the event we must cancel an appointment, you will receive full notification and the opportunity to reschedule at no additional cost.

Fees and Payment

Pricing Structure

Our fees are based on the following factors:

• Type of notarial service required
• Number of documents and signatures
• Number of signers
• Location and travel distance
• Appointment urgency (same-day, after-hours)
• Day and time of service

Payment Terms

• Payment Due: Payment is due at the time of service unless other arrangements have been made in advance.
• Accepted Payment Methods: We accept cash, credit cards, debit cards, and electronic payment methods.
• No Refunds: Once notarial services have been performed, fees are non-refundable.
• Returned Payments: A fee will be charged for any returned or declined payments.

Client Responsibilities

Valid Identification

You must present a valid, government-issued photo identification at the time of the appointment. Acceptable forms of ID include:

• Driver's license
• State-issued ID card
• U.S. passport or passport card
• Military ID

Failure to provide acceptable identification will result in the notary being unable to perform services, and you will still be charged the trip fee.

Document Preparation

• All documents must be complete and ready for signature. Notaries cannot fill in blank spaces or complete documents.
• You are responsible for understanding the contents of any document you sign.
• The notary will not notarize incomplete documents, blank forms, or documents with blank spaces that should be filled before signing.

Signer Presence and Willingness

• All signers must be physically present before the notary at the time of notarization.
• Signers must be of sound mind and signing willingly, without coercion.
• The notary reserves the right to refuse service if the signer appears to be under duress, lacks capacity, or is otherwise unable to execute the document.

Limitation of Liability

Grace Notary Ink's liability is limited to the maximum extent permitted by law. We are not responsible for:

• The legal effect or enforceability of any document notarized
• The accuracy or completeness of information contained in documents
• Errors in documents prepared by third parties
• Rejection of documents by third parties or government agencies
• Consequential, indirect, or incidental damages arising from our services
• Delays caused by traffic, weather, or other circumstances beyond our control

Grace Notary Ink maintains errors and omissions insurance and a surety bond as required by Idaho state law.

SMS and Text Messaging Terms

Description of SMS Services

By providing your mobile phone number when booking an appointment or using our services, you consent to receive SMS text messages from Grace Notary Ink for the following purposes:

• Appointment Confirmations: Confirmation of your scheduled notary appointment
• Appointment Reminders: Reminders about upcoming appointments
• Schedule Changes: Notifications about any changes to your appointment time or location
• Service Updates: Important updates related to your notary service request
• Follow-Up Communications: Post-appointment follow-ups and satisfaction surveys
• Promotional Messages: Special offers, discounts, and marketing communications (only if you opt in)

Message Frequency and Costs

Message frequency varies based on your appointment activity and communication preferences. You may receive appointment-related messages as needed for each booking. Message and data rates may apply based on your mobile carrier's plan. Grace Notary Ink does not charge for text messages, but your carrier may apply standard messaging rates.

Opt-Out Instructions

You may opt out of receiving SMS messages at any time by:

Please note that opting out of promotional messages will not affect transactional messages necessary for appointment coordination and service delivery.

Carrier Liability Disclaimer

Carriers are not liable for delayed or undelivered messages. Grace Notary Ink and mobile carriers are not responsible for any delays in the receipt of SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an "as is" basis.

Supported Carriers

Our SMS service is available on all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, Boost, Cricket, MetroPCS, U.S. Cellular, and most other carriers. Message and data rates may apply.

Privacy and Confidentiality

We are committed to protecting your privacy. Please review our Privacy Policy for detailed information on how we collect, use, and protect your personal information, including your mobile phone number and SMS messaging data.

As a notary public, we are required by law to maintain a record (notary journal) of all notarial acts performed. This journal is confidential but may be subject to subpoena or review by government authorities.

Prohibited Uses

You agree not to use our services for any unlawful purpose or in any way that:

• Violates any local, state, or federal law or regulation
• Involves fraudulent, false, or misleading documents
• Attempts to defraud or deceive any person or entity
• Harasses, abuses, or threatens our notaries or staff
• Interferes with the proper performance of notarial duties

Professional Standards and Ethics

Grace Notary Ink and all notaries associated with our business adhere to:

• Idaho notary public laws and regulations
• The National Notary Association Code of Professional Responsibility
• Signing Professionals Workgroup best practices
• Highest standards of integrity, impartiality, and professional conduct

Our notaries reserve the right to refuse any notarization that appears improper, illegal, or fraudulent.

Indemnification

You agree to indemnify, defend, and hold harmless Grace Notary Ink, its owner, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

• Your use of our services
• Your violation of these Terms of Service
• Your violation of any rights of another person or entity
• Any fraudulent or illegal documents presented for notarization

Modifications to Terms

Grace Notary Ink reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified terms.

Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the courts of Ada County, Idaho.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms of Service will otherwise remain in full force and effect.

Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and Grace Notary Ink regarding the use of our services and supersede any prior agreements.

By booking an appointment or using Grace Notary Ink services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
